Fri, Jun. 24, 2005: South Dakota: Judge denies new trial for man convicted of molesting nursing home resident:"Circuit Judge Janine Kern denied a request for a new trial for a Rapid City man convicted of sexually molesting a 76-year-old nursing home resident. Les Kills Small, 28, argued in part that the jury didn't receive proper instructions before convicting him of second-degree rape. He was sentenced to 60 years in prison."

At first glance, the ordinary consumer would probably scream "how could this happen."
Giving serious thought to the lack of security, lack of staff and poor background screens done in long term care, it isn't very difficult to imagine this happening.

It is down right scary out there on top of worrying if the residents are getting the nursing care they need, and if you even have enough staff to work, you have to worry about the new staff molesting patients? and if you consider how often new staff go unsupervised due to shortages it makes you question how many atrocities do take place that go undetected?
What is really scary is that a large number of violent criminals are entering the age where they'll need to go into nursing homes. At present there is no screening process to keep even sex offenders out of nursing homes and away from vulnerable adults.
Talk about bringing the fox to the hen house.

we're already having to deal with nurses or nurse aides molesting the residents, and honestly, I think the job will become more appealing to sexual offenders over time, as more men enter the field, and they realize there is opportunity to have direct one on one contact with "compromised" people. I'm not saying there aren't female nurses or nurse aides who do this, but let's face the facts men are the VAST majority of sexual predators.
Having to worry about nursing home RESIDENTS is something that could CREEP up on us in a hurry. With the growing number of registered sex offenders, it will soon become a fact, that they too will need nursing care in a long term care facility. Scary. Very scary.
Sick people who do these kinds of things, man...
We should have much stricter laws regarding this growing nightmare. Two strikes and not only are you out, but you are out of this world. I have no problem ridding the world of people who abuse/molest children and the elderly, and of course anyone else for that matter.
So not only do we have to worry about sex offender/violent patients, but also employees with questionable backgrounds.
At least when you're dealing with vulnerable populations, most nursing homes are starting to do criminal background checks. Fingerprint screening against a national database would be even better.
I've got a sickening feeling that we'll be hearing a lot more about this issue in the years to come. There will be a lot of traumatized patients and family members that mistakenly assumed their loved ones in nursing homes were safe.
