The nursing program at Miami-Jacobs Career College will stay open for weeks, maybe months, pending an appeal by the school of the Ohio Nursing Board’s decision to revoke the college’s license.

Franklin County Common Pleas Judge Richard A. Frye granted the school’s request for a stay during an emergency hearing Tuesday, hours after the college’s attorney Elizabeth Collis filed an appeal of the nursing board decision.

In a written statement, Ned Snyder, Dayton campus director, applauded the court decision.

“We are glad that Judge Frye recognized the significance of the improvements we have made in our programs and that we have made every effort to work with the Ohio Board of Nursing to comply with their standards,” Snyder said.

“More important, we are most happy that our current nursing students will be allowed to return to school immediately to complete their course work, graduate, prepare and stand for their licensing exams and receive their state certifications.”

The nursing board voted Jan. 21 to revoke the college’s conditional approval to teach practical nursing after multiple site inspections found unqualified staff and other curriculum problems. The board’s revocation order said the college had “too many opportunities to correct issues” it “continued to provide misleading information” and “did not persuade the board with a mitigating argument in favor of continuing the program’s approval status.”

The appeal filed by the college says 82 students are enrolled in the program at a total of three campuses with 23 within a few weeks of graduation. The college stopped enrolling students in the program last year after it came under increased scrutiny from the nursing board. If the program loses state approval those students would be unable to take nursing licensing tests.

The college has said it is correcting problems and hired an outside consultant to help with compliance to state nursing education rules.

The appeal process could take weeks or months to be concluded, court officials said.
